Disaster Capitalism and Sandy
In 2008 I wrote an essay about the application of Naomi Klein's "shock
doctrine" thesis in New Orleans in the wake of Hurricane Katrina: Nadesan,

exploitation could occur in the wake of Sandy.

America's Other Civil War - the One Breaking Out Within the GOP
Do moderate Republicans now wish their party had chosen Santorum or
Gingrich instead of Romney to take on Obama? Some, weighing up their
bitterly divided G.O.P. in the wake of the Obama re-election, think that
might have been the best thing for the party.
*Some believe Romney came close enough to victory to allow an even fight in
the coming Republican civil war and thus ensure a protracted and painful
debate that will stretch on for years. What the party really needed, some
think, was to have nominated a died-in-the-wool ultra-conservative in 2012

Pierre Trudeau swept onto the Canadian political scene like a prairie fire.
Trudeaumania really happened. He was never, however – until perhaps late in
his career – committed to the idea of real independence for Canada. Walter
Gordon was uneasy about Trudeau from the beginning, as he had good reason
to be.
I was asked, of course, how I could support Trudeau for the leadership in
view of the fact he was supposed to be lukewarm on the independence issue

Amaia Egana Suicide Death Jump As Bailiffs Move In, Spain
A mother in Spain jumped to her death as bailiffs approached to evict her
from her fourth-floor flat, officials have said.
Amaia Egana's death was the country's second apparent suicide linked to
evictions, with authorities under mounting pressure to ease tough mortgage
laws.
Around 500 evictions are being carried out each day across Spain, which is
beset by a sinking economy.

Petraeus resigns over affair
Few details but just now, CIA head David Petraeus resigned because of an
extra-martial affair. All the smart people are saying he had to do it
because, blackmail. Not sure how that works once the affair has been
admitted. What leverage does the rejected lover have once it's made public?
Always being the outlier, I'm not a fan of his at all, but I find it hard
to believe he would compromise national security for sex. Think it's more
likely he had a fling with a younger woman, because that's what men so
often do at that stage of marriage, and wants to spare his wife and family

An Open Letter to Rachel Notley, MLA for Edmonton-Strathcona
I will preface this post with the following -
Generally, I don't comment on political topics that often. Mostly, this
stems from my general disdain for politicians in general. Also, it is
connected to my workplace and one thing I've learned over the course of my
working life is that its never a smart idea to bite the hand that feeds
you. In this case, though I thought I'd make an exception as there has
been an issue floating around that has generated some chatter, namely the
issue of a random drug testing policy for one of the big sites here.
A local union took issue with this... more »

Don't ask me what goes through these guys' heads, these great Defenders of

Drawing adverse inferences from failure to produce evidence
*Parris v. Laidley*, 2012 ONCA 755 makes clear that drawing an adverse
inference from a failure to produce evidence is dangerous. Such should only
be done if it is very clear the evidence should, could and ought to have
been called. The dangers of such an inference being overturned on appeal
suggest it may be prudent not to seek they be drawn. The Court holds:
[2] Drawing adverse inferences from failure to produce evidence is
discretionary. The inference should not be drawn unless it is warranted in
all the circumstances. What is required is a case-specific inquiry into ... more »

Our Galaxy’s Black Hole Is Getting Angry
By Jamie Condliffe
The black hole at the center of our galaxy isn't happy. In fact, it's
spitting out its biggest X-ray flares ever, which are a hundred times more
powerful than anything it's ever produced before.
It's not clear why it eject X-rays like this, but it sure looks angry when
it does—just like in this image, which was captured by NASA's Chandra X-Ray
Observatory. [The Astrophysical Journal via New Scientist]

Energetic Release Occurs as Entanglements Dissolve

Energetic release occurs as entanglements dissolve. Arboreal expansion

Relief for discrimination limited to claims before a hearing tribunal
Moore v British Columbia 2012 SCC 61 rather unexpectedly rules in favour of
a claim of discrimination under the BC Human Rights Code for a case of
dyslexia. In so doing, however, the Court limited the relief granted and
held that it is improper for a human rights tribunal to make sweeping
orders that would alleviate discrimination against parties not before the
tribunal. The Court rules:
[64] But the remedy must flow from the claim. In
this case, the claim was made on behalf of Jeffrey, and the evidence giving
concrete support to the claim all centred on... more »
Abuse Allegations: Media and Power
Guest post (courtesy of Twitlonger) from @catherinebuca.
The news isn't Schofield or Watson or *Newsnight* or people talking on the
internet; the news is why children have had their complaints of abuse
ignored, and are still having them ignored. The news is if, how, why and by
whom investigations into these alleged crimes have been circumscribed. The
news is what kind of power circulates in society in order to protect
certain people no matter their crime.
This is nothing but distraction.

Provisional Ballots Spoiled By Restrictive State Law, ACLU of Arizona Says
ACLUAZ
Jon O'Neill
PHOENIX – A restrictive Arizona law helped invalidate thousands of ballots
cast in the 2008 election, a new report by the ACLU of Arizona shows. The
disfranchised voters, more than 13,000 of them, used provisional ballots,
an option meant to help people who, for many reasons, wind up at the wrong
precinct on Election Day. But Arizona law requires that even a provisional
ballot be cast in the right precinct. All voters leave the polls expecting
their ballots to be counted. But for one in every 10 Arizona voters who
cast a provisional ballot in 2008, they didn't.... more »

U.S. Media Whitewashes Al-Qaeda's Atrocities In Syria
"One is more certain to influence men, to produce more effect on them, by
absurdities than by sensible ideas." - Napoleon.
At first, the U.S. media ignored the heavy presence of Jihadist terrorists
in Syria because such coverage would deviate from the official line that
the anti-Assad rebels are democratic-minded freedom fighters who are worth
backing with U.S. money and arms.
But, after a while, the *official narrative unraveled*. The media couldn't
hide the reality anymore so they changed their strategy, choosing instead
to celebrate the aggressiveness of the terrorists and the... more »
Can Conservatives Win Again?
That's the question pundits are asking in the wake of Barack Obama's

Get Filibuster Reform Right
It's looking more and more as if something will happen on filibuster
reform. Greg has a total of 50 Members of the new Senate on record as supporting
at least some kind of reform. That includes the Majority Leader, which
makes some action at least somewhat likely.
The key to filibuster reform, however, is getting it right. And that's not
easy.
There's a lot of bunk on filibusters, including in proposals from Senators,
who should know better. For examples, there's been a flap for some time
about trying to prevent "secret" holds. The problem is that making holds
public wasn't likely ... more »

The tactics included fake robocalls telling voters of changes in poll
locations, stiff new voter ID laws, closing advance polls early or holding
them on a single day, strict voter registration lists, questionable purging
of voter lists and voting-day polling station intimidation.
