Confession rule applies to suspects even prior to arrest or detention
R. v. D.M., 2012 ONCA 894 is a source for the principle that the confession
rule applies prior to arrest or detention:
[40] When the appellant was interviewed by Sutton, he was not under
arrest, nor was he detained. His rights under the *Canadian Charter of
Rights and Freedoms*were not triggered. However, I agree with the
appellant that when he was interviewed, he was a suspect, indeed, the
target of a criminal investigation. Therefore, the common law confessions
rule, described by the Supreme Court of Canada in *R. v. Oickle, *2000 SCC
38, [2000] 2 S.C.R. 3, applies. The... more »

Jacob Ostreicher out on bail in Santa Cruz
While still not free, Jacob Ostreicher got a Chanukah present from the
Bolivian government: he was allowed out on bail. There are complications to
his case, which is not being helped by the presence of US politicians,
journalists and out of work actors who are known to punch women. No need to
name names.
Jacob is caught in this circus, an innocent victim of drug dealers and the
GOP.
We continue to support his release, and to support the MAS government in
Bolivia as it tries to clarify what is going on.
Catch of the Day
Goes to David Greenberg, who makes the case that "the campaign to defeat
[Robert Bork] was neither unprecedented nor illegitimate." Absolutely true.
Greenberg traces the history of Supreme Court nominations, noting that
three nominations had been defeated within twenty years of the Bork defeat,
with each drawing plenty of harsh words from their opponents -- as did
justices who were confirmed in that era, including Thurgood Marshall
and William Rehnquist.
What I'd add to that is just that context matters, too. Greenberg
emphasizes that the long stretch of the twentieth century during... more »

WASHINGTON (MSN News) – As 2012 began, winter in the U.S. went AWOL. Spring

fall hit the eastern third of the country with the ferocity of Superstorm

Conservative ALEC Economic Policies Lead Have No Benefiit, Some Risks, for States
The economic policies proposed for states by the conservative American
Legislative Council Exchange (ALEC) not only don't work, but carry risks
for states' economies, according to new research by the Iowa Policy Project
and Good Jobs First.
As we have seen most recently with Michigan's passage of anti-union
so-called "right to work" legislation (which lets people free ride on union
contracts and makes union organization and representation more difficult),
the legislative agenda of ALEC proclaims that states should follow a
low-tax, low-wage, non-union route to economic prosperity. N... more »

Time To Repeal Anti-Communist Discrimination Laws?
Is there any group more irrelevant in America today than communists? Back
when Joe McCarthy was in his heyday smoking out suspected communists and
socialists, our major rival on the international arena was the Soviet

fresh uncertainty over talks to avoid across-the-board tax hikes and
spending cuts that could push the U.S. economy into recession in 2013.

Bugarach Sealed Off As 'Doomsday Nears'
A tiny village in the Pyrenees has been sealed off as police try to prevent
an invasion by those seeking salvation from a predicted apocalypse.
The jagged mountain which dwarfs Bugarach is said to contain aliens, who
plan to board a spacecraft and flee the Earth before the end of the world.
There are those, admittedly in a minority, who believe the ETs may take
some humans for the ride, allowing them to perpetuate humanity.

Expanding Dust Bowls in China and Africa Threaten Food Prospects
The following article was written by Janet Larsen, Director of Research for
the Earth Policy Institute.
When most people hear the term “dust bowl,” they think of the American
heartland in the 1930s, when a homesteading wheat bonanza led to the
plowing up of the Great Plains’ native grassland, culminating in the greatest
environmental disaster in U.S. history.
Despite warnings from researchers and some farmers, history repeated itself
in the Soviet Virgin Lands Project in the 1950s to early 1960s. Some 100
million acres (40 million hectares) of grassland wer... more »
No One Knows Where This Will Lead
Wit's End - 7 hours ago
So many disparate events have conspired to delay a timely post here at
Wit's End that I won't even attempt to outline them (briefly - an onslaught
of dire papers presented at the AGU conference in San Francisco, the
horrific shooting in Connecticut - and a whole lot in between). This
laggard posting is not due to any dearth of material about trees dying from
ozone; alas. To the contrary there is far, far too much and it has all
been accumulating like an insatiable and slovenly fat monster - so be
warned! Please don't complain - I have been far more tormented writing

Some good news
Assuming the Mayans were wrong then here's some good news.
At 11:12 GMT today, the sun will reach its (apparent) southernmost point

hemisphere the days will start getting longer. In other words today is the

FROM CONNECTICUT TO CHINA - CONTROL BY CHILD ABUSE
The son of a leading faculty member at a Connecticut prep school was making
a documentary on child abductions.
"He had no intention of saving kids from these criminals, since his stated
ambition was to launch a pornography industry in China."
*The Connecticut prep school "sponsors troubled boys and prepares them for
a life of male prostitution, with dormitory screenings of videos showing
the gang rape of preteen girls."*
This is done "with the knowledge and sometimes approval of teachers,

China to Move 700 Mountains - Literally
A long, long time ago, an old Chinese peasant named Yu Gong decided to move
two inconveniently located mountains away from blocking the entrance to his
home. Legend has it he struggled terribly, but ultimately succeeded. Hence
the Chinese idiom "Yu Gong moves the mountains." Where there's a will,
there's a way. Now Chinese developers are putting old Yu to shame.
In what is being billed as the largest "mountain-moving project" in Chinese
history, one of China's biggest construction firms will spend £2.2bn to
flatten 700 mountains levelling the area Lanzhou, allowing developers to

Does Greater Efficiency Lead to Greater Waste?

Apocalyptic Neocons Fear That Hagel As Chief of Pentagon Will Mark End of Israel's Special Status

Mayan Calenders and Today
The only thing that is interesting about this date is that we understand
the Mayan Calender and its link to astronomy and their marvelous system for
doing large numbers. This allowed for a date in the distant future to be
easily named but likely linked to an extant event as the one real point of
reference. It may even be astronomical but just as plausibly honoring a
ruler who came under the correct signs thus linking it indirectly to
astronomy.
In the meantime it is worth noting just how well the ancients managed to

Thirteen Years on Death Row
What DNA testing has accomplished is to highlight in a very public way the
utter shortcomings of a seriously overtaxed justice system that ultimately
places justice itself as a low priority.
We all understand that the present drug criminalization regime has become

these horrors.
In my case it took one of the worst serial killers to help me understand
that the death penalty is a very bad idea. I came to understand that I did

It is noteworthy that this initial survey of local cultural sources came

SO, WHO’S APPEASING WHO IN THE MIDDLE EAST?
Neocons are often apt to use the analogy of Chamberlain’s appeasement of
Hitler prior to World War Two to highlight the so-called danger they think
the West puts itself in when trying to avoid a confrontation between the
West and Iran. But, at the end of the day, the reality is that it is the
neocons that are trying, in a somewhat perverse sense and twist to the
notion of appeasement, appease the Zionists of Israel inasmuch that it’s
the Israelis and their neocon supporters who want to attack Iran – just as
Hitler and the Nazis wanted to attack East Europe.

Western Marxism (both the train of thought called Western Marxism and
