We first really saw this problem in the mining industry. It became more profitable to claim a huge successful mine discovery, than to actually locate a physical mine. At least to the thieves. The industry responded by rewritting the rules for disclosure and demanding acceptable protocols that could be repeated by a body of professionals. This had the benefit of tossing a lot of historical into the legal ashcan and made any of that work properly repeatecd.
