DeVos Offers Advice From Within The Bubble

Peter Greene at CURMUDGUCATION - 9 hours ago
Betsy Devos is rich. She was born rich, married rich, and barring any French Revolution style upheaval, she will die rich. This does not automatically make her evil, but it does make her susceptible to life in a bubble-- particularly since she never created nor ran any of the businesses that made her wealthy. And it's important to remember all this when she starts waxing rhapsodic about the lessons she learned growing up back in the day. DeVos returned to the public eye this week, wheelchair bound from a broken pelvis that was the result of a biking accident (that has got to hurt li... more »

Pelosi Takes Heat For Ignoring Her Minions Antisemitism

Herrera v. Wyoming: A Cautionary Encounter with Careless Repudiation

Guest Blogger at Balkinization - 10 hours ago
Daniel B. Rice and Jack Boeglin The law of repudiating precedent is hopelessly muddled. The Supreme Court often simply overrules decisions whose reasoning it chooses to disavow. But it sometimes stops just short of doing so—repudiating the principle underlying a case without explicitly overruling the case itself. When those enfeebled decisions are invoked in later litigation, how should the Court understand their residual force? Have they been “effectively” overruled, overruled *sub silentio*, or perhaps limited to their facts? And is there any difference between these formula... more »

No, Constructive Discharge Doesn't Equal A Lawsuit

Donna Ballman at Screw You Guys, I'm Going Home - 14 hours ago
Every once in awhile someone tells me they were constructively discharged, so they want to sue. They're surprised when I say, "For what?" That's because there’s no such cause of action or claim. Just because you were constructively discharged, that doesn't automatically equal a lawsuit any more than being fired equals a lawsuit. Constructive discharge is where an employee quits work for good cause. If you are constructively discharged, the courts treat it as if you were fired. This means some claims that you were illegally fired (worker's compensation retaliation, retaliation for co... more »

This news is a few years old, but I only just came across it: so, even if it isn't Halloween, here it is. We all have that one neighbor on the block who goes beyond the call of duty in terms of making the neighborhood festive for the holidays. And in Cleveland, Ohio that person is Amanda Destro Pierson, who turned her ordinary garage into something, dare we say, spooktacular. (Sorry, we had to...) Just take a look at what happens when the garage door goes up. There's more at the link. Here's the video. Clever! I particularly like the warning notice outside. Peter
