Such an injunction is designed to hold the status quo pending a trial. It has now been over 2 1/2 years since the first injunction application, and there is no reason why this action could not have been taken to trial. A trial court could by now have determined the damages suffered by the appellant, rendering moot any question of irreparable harm.

Last Thursday, fast-food workers in more than 150 US cities went on strike. Some 500 workers were arrested for civil disobedience, including this man, José Carillo, an 81-year-old McDonald's worker.
