Collateral facts rule
*R. v. C.L*., 2012 ONCA 752 deals with the collateral fact rule. In general
the rule provides that a party may not impeach the credit of their
opponent's witness by calling witnesses to contradict that witness on
collateral matters. But, if the evidence goes to an issue in dispute, and
is not called merely to attack credibility, the evidence is proper. The
Court writes:

There are several reasons I'm suspicious about the truth of this claim.
First, the Japanese government has used inappropriate methods for detecting

Common sense inferences may not always apply
The recent decision of *R v McConnell*, 2012 ABQB 263 points out that the
"common sense" inference that someone intends the natural result of their
actions may not always apply in the context of intoxication:
In this case, the Crown urges the Court to apply the common sense inference
that a sane and sober person intends the natural consequences of her
actions. Such an inference is just that ‑ an inference ‑ and, as with any
inference, its application depends on the circumstances of the case. As
stated by Joyce, J. in R v Robinson, 2010 BCSC 368 (CanLII), 2010 BCSC 368

Multicultural destruction of London to go UK-wide
London - like all capital cities - has been the focus of mass non-European

the import of vast numbers of non-Europeans has been to destroy our ethnic

Barack Obama has learned a lot in the last four years. During the first two
years of his presidency, many of his supporters grumbled that he didn't
understand who he was dealing with. When Republicans said that their first

But the 2010 elections got his attention. And the debt ceiling debacle
convinced him that the old admonition, "Early to bed and early to rise.
Work like hell and organize" was the only way to deal with his opposition.
And that's why Obama and the Democrats won the White House yesterday.

“Sabbatical or a sabbatical (from Latin sabbaticus, from Greek sabbatikos,

a hypothetical moment (and, in their opinion, a predictable and important
moment) at which the global oil production reaches its global maximum.
But Phys.ORG has discussed an even more far-reaching peak of something,
namely "peak star". The popular article is based on this paper:

Bahrain strips Shiite activists of citizenship amid unrest
Bahrain has revoked the citizenship of 31 Shiite activists, the latest
clampdown on the opposition amid continued unrest in the Persian Gulf
kingdom.
The state-run Bahrain TV announced the move Tuesday evening, citing an
interior ministry statement. The television anchor read out the names of
the 31 activists, which included Jawad Fairouz, a former member of
Parliament for the Shiite opposition group Al-Wefaq, and his brother, Jalal.

World's rarest whale seen for the very first time... but only when it died after beaching in New Zealand with its young calf
The world’s rarest whale, which has remained a mystery to scientists for
over 100 years, has been seen for the first time.
The five-metre whale was washed up on a beach with its calf in New Zealand,
offering the first evidence for decades that the species still exists.
The spade-toothed beaked whale (Mesoplodon traversii) had not been seen for
the past 140 years, except for the odd skull that has washed up on shore.

Dollar falls after Obama victory, fiscal cliff looms
The dollar fell on Wednesday after U.S. President Barack Obama's
re-election for a second term, which was seen ensuring Federal Reserve
quantitative easing will be in place.
But analysts said the dollar could soon resume its uptrend trend if
safe-haven flows are prompted by growing worries over the looming U.S.
"fiscal cliff". The country risks policy paralysis over a sharp fiscal
tightening due to start next year unless a deal is reached in Congress to
avert it

Foreign Policy: Obama Facing Iran Dilemma
The biggest foreign policy issue facing newly re-elected President Barack
Obama is the prospect of a nuclear armed Iran.
Tehran says it is not seeking nuclear weapons, the Americans and others

Mr Obama is on record as saying he will not allow Iran to obtain nuclear

News Coverage Note
I'll write about the elections in the morning, but for now just a quick
note on the news coverage -- specifically on CNN, since I had the TV on to
it for most of the night.
If I had to judge them on covering the presidential campaign returns, I'd
give them...maybe a B. They called states fairly slowly as far as I could
tell from what I was seeing elsewhere, but that's pretty much a plus, in my
book. They spent most of their time on the returns, and had what seemed to
be relatively little useless partisan spin. The main drawback was that they
became obsessed with the close race in Fl... more »

So Barack Obama has won re-election as President of the United States. On
the plus size that means that we will be spared months of whining Democrats
complaining about voting issues, the Republicans' complaints will be pretty
much ignored. As in the UK, the right are expected to accept defeat whilst
the left just won't.
My views were expressed in a series of tweets this morning:
ClanCast: Connecting Readers With Their Authors
Is an author or book promotion, just a case of putting an author in front
of a camera asking a few questions and posting the result on their web
site. Does that image and insight into the author’s thinking make the
difference? We have seen book promotion on television stumble along for
years, usually subject to the usual discussion on a sofa and the author
holding their new book in one hand whilst fixing the eyes on the camera and
smiling. Celebrity authors can easily get the right exposure and do it with
style and litter the studios of every chat show clutching that new release. ... more »
Chinese Cabinet Mandates Reform Plan
This request for reform comes just as a new regime is expected to take

What China needs now is staged privatization of the SOEs over a likely
twenty years combined with urban private ownership on newly built

property into the hands of the nascent middle class.
All this will also create creditable lending to individuals and the
private sector can be expected to shoulder a greater share of the national
economy.

Again it is a result of creating a micro surface to increase efficiencies
in a novel manner.

1. "Citizens United" which pretty much handed over to rich & powerful

“It's not twilight in America because Obama won. Obama
won because it was, sadly, already twilight in America… The
electorate of America now cares more about being cared for
than about having the freedom to care for themselves.”
- Michael Hurd, “It's Twilight in America”
*UPDATE*: Dians Hsieh posts the contrarian view:
“Don’t despair that so many Americans voted for Obama. Many of them voted
for him because of the issues on which he’s right (or better), such as
abortion rights, gay marriage, and immigration. So how about insisting on
changes for the better in the GOP,... more »
OBAMA NOW NOTHING-TO-LOSE PRESIDENT – WHAT NOW FOR IRAN?
Before the election the world endured edge of the seat tension as Israeli
Prime Minister Benjamin Netanyahu threatened to ‘unilaterally attack’ Iran.
They were always going to be empty threats before the elections as Obama,
having everything to lose before the election, avoided dragging the
American people into another war for Israel by offering to support
Netanyahu. Yet, despite appearing to shun Netanyahu’s request for support,
we now know that in reality Obama, by allowing the fuel for war to be sold
to Israel two years ago when Netanyahu came close to ordering an attack,

Suck On It, FOX!
I don't believe I have ever enjoyed watching FOX News - until tonight.
When they declared Barack Obama elected it was as though each of them was
made to swallow broken glass. And I've been waiting so long to see those
degenerates swallow broken glass.
Tonight may spark a lot of introspection among the far Right. They had the
corporatist backing, they had the bigots and the racists and the fundies.
They started off the race spotted a handy hunk of the electorate.

Entergy Palisades plant leak contained radiation
Federal regulators say a recent steam leak inside an auxiliary building at
Entergy Corp.'s Palisades nuclear power plant in southwestern Michigan
contained low levels of radiation.
The Nuclear Regulatory Commission says in a statement Tuesday that the leak
was contained to the building. The leak forced operators of the plant in
Van Buren County's Covert Township to remove it from service Sunday.
Repairs are planned. The NRC says it has no immediate safety concerns.
The NRC says the leak contained "very low levels of tritium" and will be
treated as radioactive liquid waste.

Benjamin Netanyahu 'ready to press the button' on Iran
"I am of course ready to press the button if necessary," he told Israel's
Channel 2 in an investigation aired on Monday evening.
"As long as I am prime minister, Iran will not have the atomic bomb. If
there's no other way, Israel is ready to act."

Cameron attacks "ludicrous" EU budget before Merkel talks
Britain's David Cameron attacked "ludicrous" European Union budget plans on
Wednesday and played down hopes its leaders can reach a spending deal later
this month, stepping up the rhetoric before talks in London with Germany's
Angela Merkel.
The British prime minister has threatened to veto the EU's seven-year
budget, fuelling a perception among many in Europe that London is casting
itself adrift from the 27-nation union.

Auditors see big problems with EU budget for 18th year in a row...and still they do nothing
OFFICIAL auditors yesterday reported major errors in EU spending last year,
amounting to billions of euros and strengthening the hands of politicians
in the UK who hope to freeze spending in the budget.
The European Court of Auditors said it had found irregularities affecting
four per cent of total spending during 2011, equivalent to around €5.2bn
(£4.17bn).
The biggest problems were in outlays on rural development, fisheries and
health, the court said in its annual report, which ran to more than 240
pages.
Most errors came from the “misapplication or misunderstanding” of the EU’s ... more »

BOSTON (The Borowitz Report)— "America cast its historic vote today,
sending Barack and Michelle Obama back to the White House while sending
Mitt and Ann Romney back to 1954. The election meant the end of the road
for Mr. Romney, who had been actively seeking the Presidency for the past

politicians must on Wednesday night vote on a fresh round of spending cuts

Samaras' proposed budget for 2013.
The austerity measures include a two-year increase in the retirement age
from the current average of 65, salary and pension cuts and another round

Nuclear Warning Over Sellafield Waste Storage
Hazardous waste being stored in run-down buildings at Sellafield nuclear
plant is posing "intolerable risks to people and the environment", a
watchdog has warned.
For more than 50 years, the owners of the Cumbrian nuclear power station
have failed to plan how to dispose of radioactive waste, according to a
report by the National Audit Office (NAO).
The public spending watchdog said some of the older facilities have
"deteriorated so much that their contents pose significant risks to people
and the environment".

Give this poor country a break
This is the first time I've lived anywhere other than Canada, let alone in

family are regularly checking in with concerned voices as to whether

Nothing to worry about, I tell them. And I mean that. Despite the endlessly
bleak news about Honduras and a truly formidable murder rate, this country
has in fact been a very pleasant place to live these past 10 months. The
place needs work, absolutely, but this seemingly global need to portray the
